    Mine too is LC substitution case.
    EB3-India-NSC-140- PD:April, 2004 - ND: 05/08/2007
    Last LUD: 05/21/2007

    Mine is a labor substitution filing and 140 is filed in TSC in April-2007. This case is transferred from TSC to NSC in Nov-2007. There are no LUDs after that. I have seen similar cases transferrred in November. Did anyone receive an approval/LUD in such cases ?

    Thanks, both of you. I got it yesterday, did a few test shots in a creek by my home and took a bunch of pics in the Black River this morning. In a fast riffle, there were some streaks from bubbles, but that didn't detract from the shot (subject was a smallmouth bass close up). In fact, I think it added the sense of current flow.
    The Black is a very clear river, but it is not like the ocean. Looks like the closer the subject the better. I'm also learning how to process these images. I've been shooting for about 40 years, but this is a whole other world, and I'm on a learning curve. It's cool, though.

    Here is my story -
    - I came here in 1998 on F1
    - Transferred to H1-B in 2002
    - Filed for Labor Cert in 2005 (EB3) in Nevada
    - I-140 approved in 2008
    - I-485 pending for more then 180 days as of 2008
    - EAD valid through 7/10/2009
    - Got laid of in Feb 2009
    - I got a job as an associate, a consultancy firm on W2 basis on Nov 17th, 2009 in WA

    I have not done anything (i.e.informing the USCIS about job change etc.). I have the following questions.

    - what documentation is required to be submitted to the USCIS about the new job.
    - What kind of documentation is required from the employer vs myself
    - When/how soon has this documentation is to be submitted
    - When do i need to apply for my renewal of my EAD card
    - What documentation is required to be submitted for the EAD renewal from employer vs myself
    - Is it advisable to employ the services of an attorney if we run into issues.
    - I worked on similar job for very short stints in between, but it was for a few weeks, does it endanger my case in anyway.


    Any advice would be greatly appreciated.

    got to the SSN office with ur receipt, tell them you are waiting for ...... long for the card. you need the number to give to the employer. most of the officers would look in the system and would give you the number.

    I have a similar timeline - applied for LC in February 2002, got approval in December 2003, filed I-140 in February 2004, I-485 in March 2004. Currently filing for my fifth EAD! The USCIS not only tortures the whole family (it's a common practice that name check is pending only for primary applicant) but makes us to pay for the wait! My son was born around the time we filed for adjustment of status, he will go to school soon but we are still not sure whether we will be allowed to stay. We cannot plan ahead and open education funds for our children. My wife cannot go to college, as she is not eligible for in-state tuition discount. Needless to say, I am forced to sacrifice my career as the whole thing is dragging for 5+ years and I have to work at the same position to keep GC process alive. I've got MCSD certificate and outgrew my position long ago. I cannot quit my job and found a new business.
    The USCIS explains the delay by national security interests, but the national security requires the very opposite - speedy processing of the background checks.

    Hello,

    Here's my situation:
    H1b: 7th Year (valid through Nov 2009)
    Labor: Approved
    140: Approved
    Category: EB2
    Priority Date: Aug 2007
    485/EAD: cannot file due to retrogression

    I have a permanent employment offer from the employer where I am contracting, right now for the same job. Following are the questions I have:
    1. Can I change my employer?
    2. Can I retain my Priority date?
    3. If the new employer files for transfer of H1, what does it mean to my extension beyond 7th year?

    Please help.

    U need to start the GC process all over again, unless ur current employer is willing to support you in filing the I-485 without revoking the I-140

    Hi,

    I had applied for my H1 extension in June 2008 and waited for some time and then upgraded it to premium processing in July. I did not get any result on my H1 extension but in the meantime my GC was approved in August. My question is will i be able to get my H1 processing fee back, at least the premium processing fee. I heard if your H1 processing doesn't get any result in certain time you will be entitled to get your money back.

    I highy doubt it that you will get any fees back from USCIS. If you ask about the status of your H1 they will just get back to you saying that your H1 application was rejected since the applicant is n longer in Non Immigrant status as your status chnaged to Immigrant as soon as your Green Card was approved. You can try but very few people have actually recieved fees back from USCIS. Good luck

    Yes you can apply for an extension on medical grounds, be sure to include a letter from her Doctor and all the hospital records and explian clearly why the extension is required, this should get approved.

    Why you take lawyer's help for this simple thing. ?
    Almost everybody renewed EAD/AP by themselves.
    EAD/AP filings must go to your I-485 processing center.
    I think, if the lawyer send to wrong center, it will redirect to the correct center, there will be a time delay for this.


    Same here! Our lawyer send our EAD,AP renewals to NSC,even though my 485 is pending at TSC(Last July got transferred from NSC).Till far no LUDs no any thing regarding them.I applied on June 30th and till far no update.Is this normal?

    It does. MS = BS + 5yrs experience per the general guideline principles followed by CIS/companies. My EB2 was applied when I had around 1yrs exp after MS. Imp thing is that the job for which your LC is being filed should have EB2 requirement. Make sure of that. Otherwise, even if a PhD candidate is employed for a layman job, it's doesn't warrant EB1. the driving factor is the job's requirement.

    I actually did get a H-1B extension once based on the fact that the spouse (also H-1B) had an approved I-140 priority date that was backlogged. It was an unusual approval, and surprised the other attorneys (including partners) where I was working. It's not guaranteed, but worth a try if there is no other option to work.

    My spouse is still on h1b and we will definitely try for this. Do you think the extension would be affected by the priority date (higher chances of approval if severely retrogressed) - or if theres something like a memo/ruling/logic for the approval, or is it just random chance?

    Also in case the motion is declined, does it lead to a future (negative) impact on either a fresh h1b filing, or green card application or such?

    I had a opt which expired on the 9th. of november and on june 08 i applied to start green card process with help of a lawyer.I have a master degrees from the US and my lawyer told me that i did not need to apply for a H1 visa or a work permit and could directly go for green card. we started the process in june 08 and I applied to eta 9089 on september 08 and could not get any reply back for almost 5 months. My lawyer tells me that it is normal to not get an answer for so long even thought I think we had to get an answer in 3 to 4 weeks after september. Now, my lawyer suggests me to go back to my country as my status will be put of satatus and I could continue my green card process from back home.

    I would like to know if my lawyer is telling me the truth or my lawyer made any mistake..

    I need help!!!
